Welcome to the flux3ai.com platform (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the flux3ai.com website, applications, products, and services.

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

• Nature of the Platform

The Platform is an independent AI-powered creative interface that enables users to generate, edit, transform, and manage visual content and related outputs using artificial intelligence tools and third-party model infrastructure.

The Platform is an independent product and is not affiliated with, endorsed by, or sponsored by Google or any third-party model provider unless expressly stated otherwise. Any reference to specific models, providers, or technologies is descriptive only and does not imply endorsement, sponsorship, partnership, or official association.

• Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Platform. By using the Platform, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.

• Account Registration and Security

You may need to create an account to access some features. You are responsible for:

maintaining the confidentiality of your login credentials,

all activities that occur under your account,

providing accurate and current information,

promptly notifying us of any unauthorized use or security breach.

We may suspend or terminate accounts that are inaccurate, misleading, abusive, insecure, or used in violation of these Terms.

• Subscription, Billing, and Credits

Some features may require payment, a subscription, or the use of credits. By purchasing a subscription or credits, you authorize the applicable payment processor to charge your selected payment method.

You are responsible for reviewing pricing, billing frequency, renewal terms, usage limits, and any applicable credit rules before purchase. Unless otherwise stated, subscriptions renew automatically until canceled.

We may change pricing, features, usage limits, subscription structures, or credit allocations from time to time. Material changes will apply prospectively.

• User Inputs and Outputs

You may provide prompts, text, images, files, references, instructions, settings, and other materials as input (“Inputs”). The Platform may generate images, video, text, metadata, or other materials as output (“Outputs”).

You retain any rights you may have in your Inputs and, subject to applicable law and third-party rights, in your Outputs. You are solely responsible for:

your Inputs,

your Outputs,

your decisions to use, publish, distribute, sell, license, or rely on Outputs,

ensuring that your use of the Platform complies with these Terms, our Acceptable Use Policy, and all applicable law.

You acknowledge that AI-generated content may be inaccurate, incomplete, misleading, biased, or unavailable for legal protection in some jurisdictions. You must review Outputs before use and may not rely on them as legal, medical, financial, safety-critical, identity-verification, or professional advice.

• Prohibited Uses

You may not use the Platform to create, request, upload, edit, transform, process, distribute, store, or facilitate prohibited content or conduct.

Prohibited uses include, without limitation:

a. Adult, sexual, and NSFW content

You may not use the Platform to generate, edit, upload, request, process, or distribute:

pornographic content,

sexually explicit content,

nude or semi-nude content,

sexually suggestive or erotic content,

fetish content,

explicit sexual acts,

implied nudity intended for arousal,

sexualized body emphasis intended for arousal,

sexual roleplay content,

sexual deepfakes,

non-consensual intimate imagery,

content that attempts to sexualize young-looking persons,

any other adult or NSFW content.

b. Child exploitation and unsafe content

You may not create, request, upload, or distribute any content involving minors in sexualized, exploitative, abusive, or otherwise unsafe situations.

c. Violence, abuse, and exploitation

You may not use the Platform for exploitation, abuse, blackmail, harassment, humiliation, unlawful violence, or content that promotes or facilitates such conduct.

d. Hate, extremism, and harassment

You may not create or distribute hateful, extremist, discriminatory, or targeted abusive content.

e. Fraud, deception, impersonation, and unlawful conduct

You may not use the Platform for scams, fraud, impersonation, misinformation, forged evidence, deceptive endorsements, or unlawful activity.

f. Rights violations

You may not infringe the copyright, trademark, privacy, publicity, contract, or other legal rights of any person or entity.

g. Circumvention

You may not attempt to bypass or interfere with safety systems, moderation, prompt screening, rate limits, account limits, billing restrictions, security controls, or access restrictions.

• Moderation and Enforcement

We may use automated systems, prompt screening, content safety tools, rate limiting, metadata review, trust and safety processes, and manual review to detect and prevent prohibited use, abuse, fraud, or policy violations.

We reserve the right, at our sole discretion, to:

block prompts or requests,

refuse or remove Outputs,

suspend or terminate accounts,

restrict access to features,

cancel subscriptions or credits where permitted,

investigate suspected violations,

cooperate with lawful requests from regulators, payment providers, or law enforcement.

• Availability and Changes

We may modify, suspend, limit, or discontinue any feature, model access, workflow, pricing, or part of the Platform at any time, with or without notice, to the extent permitted by law.

• Intellectual Property

The Platform, including our software, interface, branding, design, documentation, and site content, is owned by or licensed to us and protected by intellectual property laws. These Terms do not grant you ownership of the Platform itself.

You may not copy, reverse engineer, scrape, frame, resell, sublicense, or exploit the Platform except as expressly permitted by us or by law.

• Third-Party Services

The Platform may rely on third-party hosting providers, model providers, payment processors, analytics tools, customer support tools, and content moderation services. We are not responsible for third-party services except as required by law.

• Disclaimers

The Platform and all Outputs are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and uninterrupted operation.

We do not guarantee that the Platform will be error-free, secure, always available, or suitable for any specific use.

• Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or for lost revenue, profits, data, goodwill, or business opportunities arising from or related to your use of the Platform.

Our aggregate liability for claims arising out of or related to the Platform will not exceed the greater of:

the amount you paid to us in the 12 months before the event giving rise to the claim, or

USD $100.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

• Indemnification

You agree to defend, indemnify, and hold harmless the Platform, its operators, affiliates, service providers, officers, directors, employees, and agents from and against claims, liabilities, damages, losses, and expenses arising out of or related to:

your use of the Platform,

your Inputs or Outputs,

your violation of these Terms,

your violation of any law or third-party right.

• Termination

We may suspend or terminate your access at any time if we believe you violated these Terms, our Acceptable Use Policy, payment or safety requirements, or applicable law.

Upon termination, provisions that by their nature should survive will survive, including ownership, disclaimers, limitations of liability, indemnity, and dispute provisions.
